The Critical race theory (CRT) began in the United States of America after the end of the Civil Rights era. Even though the civil rights legislation was being enacted, critical race theory scholars in the 1970’s and 80’s started bringing to the limelight and exploring the Critical Legal Studies (CLS) in classes, also in the economic structure and in the law to analyse the role of Law of the U.S. in providing wind to the fire of racism. CRT originated in the mid 1970’s.

Critics from the academic arena term this theory as a narrative which lacked actual facts. From the year 2020, U.S. lawmakers of the conservatives have come forward to ban and completely restrict the use of CRT along with other anti-racism education in primary and secondary schools. The supporters of such bans argue that CRT is a false theory and anti-American and a means of villianizing white people.

Critical race theory can be explained in simple words as a intellectually and socially backed movement. A movement which was brought forward by activists and civil rights scholars who challenged the american liberal approaches and justifications to racial justice.

CRT links heavily its concepts to intersectionality. It is a form in which different structures or forms of inequality are affected by the interconnections of races, classes, genders etc. According to the scholars of this theory, race in itself is a product or evolved idea of society and there are no biological basis of race. Such scholars also opined that race brings forward the interests of the white people at the expense and cost of the other section, that is, the colored people.

Also, whatever the ideas the liberals put forward as neutral are in reality only “so called neutral”. It doesn’t, in reality, help neutrality also as opined by these scholars.

Criticisms

There has been numerous academic criticisms on the aspects of this theory, most predominantly by jurists and legal scholars on a wider political arena. The main emphasis on such criticisms were based on the theory’s emphasis on narration and storytelling.

Critiques also question the idea of truth, which in itself is rather objective. According to critiques, it lacked facts and heavily depended on skepticism. Critiques also put forward that any mere form of inequality is considered and interpreted by the theory as a full fledged proof of institutional racism.
